Welcome to the CSI ColorWorld (CSI is a division of DyStar LP). The purpose of this blog is to establish a creative networking environment in which CSI and DyStar employees and other interested parties can share knowledge, experience and inspiring content on color related topics.  Please review the following terms and conditions that govern your use of CSI’s website, including the online store and blog (the “Site”). Please note that your use of the Site constitutes your agreement to follow and be bound by the following legal notices and terms and conditions (collectively, the “Terms”).

DyStar has the right but not the obligation to modify any content you submit to or publish on the CSIColorWorld blog (“Content”).

You must own all Content, and you must not post to the CSIColorWorld blog anything that will cause injury to any person or entity.  You agree to indemnify DyStar for all claims resulting from Content you supply.

All comments and opinions expressed on CSIColorWorld blogs are those of the contributors only, and do not necessarily represent the views of DyStar. DyStar is not responsible for any comments written by non- DyStar contributors and disclaims any and all liability for their texts.

By posting Content to the CSIColorWorld blog, you grant DyStar and its affiliates a perpetual, non-exclusive, irrevocable, fully-paid, royalty-free, sub-licensable and transferable, worldwide license under all copyrights, trademarks, patents, trade secrets, privacy and publicity rights and other intellectual property rights you own to use, reproduce, transmit, create derivative works based upon, and otherwise exploit such Content, in whole or in part, in all media formats now known or hereafter devised, for any purpose, all without further notice to you, with or without attribution, and without the requirement of any permission from or payment to you or to any other person or entity.

1.  Intellectual Property and Restrictions on Use.
   Unless otherwise noted, all text, images, graphics, photographs, designs, icons, sounds, information, data, software and other materials (the “Content”) on the Site are copyrights, trademarks, service marks or other intellectual property or proprietary rights owned or licensed by DyStar or its affiliates. Any use of the Content or the Site other than for its intended purpose is strictly prohibited. You may not reproduce, distribute, publish, transmit, modify, create derivative works from, or in any way exploit, any of the Content, in whole or in part, for any purpose, without DyStar’s prior written consent; provided that you may include on your website reasonably limited excerpts from the Site for non-commercial purposes so long as you include a conspicuous link to the Site along with that excerpt.
2. Trademarks.
   CSI or its affiliates own or license all trademarks, service marks, and trade names on the Site unless stated otherwise on the Site. You may not use these marks without CSI’s prior express written permission. CSI grants a limited license to print media publishers only to use the trademarks and service marks found on the Site solely for the purpose of illustrating an article.
3. Rights of User.
   Except as expressly provided above, CSI is not granting you a license under any copyright, trademark, service mark, patent, or other intellectual property or proprietary right in Content, and nothing in these Terms will be interpreted as conferring by implication, estoppel, or otherwise any license or right under any patent, trademark, copyright, or other proprietary, intellectual, or other right of DyStar, its affiliates, or any third party. You obtain no rights in the products, services, processes, or technology described on this Site by accessing or using the Site. DyStar and its affiliates, and all third party owners, retain all of those rights.
4. Copyright Infringement Claims.
   If you are a copyright owner and believe that your work has been copied and posted on the Site in a way that constitutes copyright infringement, please provide us with notice containing the following information: (i) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (ii) identification of the copyrighted work or works claimed to have been infringed; (iii) identification of the material that you claim is infringing and a description of where the material that you claim is infringing is located on the Site; (iv) your address, telephone number, and e-mail address; (v) a written statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Any notification by a copyright owner or a person authorized to act on its behalf that fails to comply with these requirements will not be considered sufficient notice and will not be deemed to confer on DyStar actual knowledge of facts or circumstances from which infringing material or acts are evident. 5. MyCSI.
   In order to access the MyCSI area of the website, you will need to register. In connection with the registration process, you will be asked for certain information. You represent that any information you provide to DyStar during this registration process is accurate, to the best of your knowledge. You agree not to impersonate another person or create false account information. You agree to promptly update any account information when such information changes.
   In connection with registering for access to the MyCSI area of the website, you also will be assigned a username and password. Your username and password are for your own use only. You must keep them confidential and you must not disclose them to anyone else. You are responsible for all activity on the website through the use of your username and password. If you believe someone else may have gained access to your username and password for any reason (including without limitation due to theft or inadvertent disclosure), you should change them immediately.
   DyStar uses security measures to protect against unauthorized access to MyCSI accounts. However, no security measures are perfect and you agree that DyStar is not responsible for any failure of such security measures to prevent unauthorized access to an account. You agree to observe all security features on the MyCSI area of website and not to disable or circumvent any security features or devices.
   DyStar reserves the right, in its sole discretion, to suspend user privileges and block your access or use of MyCSI (in whole or in part) temporarily, indefinitely, or permanently at any time, for any reason, with or without prior notice.
6. External Sites and References to Other Companies.
   DyStar does not monitor or control the content of any websites linked to or from the Site. Therefore, DyStar cannot be responsible for the content of any such websites or the actions taken by the operators of such other sites. Any reference on the Site to other companies or their products or services (including links to other websites) does not constitute or imply DyStar’s endorsement or recommendation of that company or its products and services.
7. Disclaimers and Limitations of Liability
   Product images and calculations are approximations and estimations only.  The Site may include technical inaccuracies, typographical errors or other errors and omissions. Therefore, DyStar cannot be liable for your reliance on the Site for any purposes.
   THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND DyStar DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, RELATING TO THE SITE OR THE CONTENT, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, AS WELL AS ANY WARRANTY OF FUNCTIONALITY, ACCURACY, CURRENCY OF INFORMATION, COMPLETENESS, RELIABILITY, OPERABILITY, USE, PERFORMANCE OR ABSENCE OF VIRUSES.
   NEITHER DYSTAR NOR ITS AFFILIATE SHALL BE LIABLE UNDER ANY CIRCUMSTANCES ARISING FROM YOUR USE OF THE SITE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST REVENUES AND PROFITS, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.Some jurisdictions may not allow the foregoing disclaimers and limitations of liability to some extent. In such jurisdictions, those provisions shall apply only to the extent permitted by applicable law.

   DyStar may modify or supplement these Terms at any time without notice. Therefore, you should visit this web page periodically to determine the current Terms to which you are bound. DyStar may also make changes to the Content on the Site (including, without limitation, the products and prices on the Site) at any time without notice.
9. Severability.
   If any provision in these Terms is held to be invalid, illegal or unenforceable for any reason, the remaining provisions shall remain effective to the fullest extent permitted by applicable law.
10. About Children.
    The Site is not intended for children under the age of 13.  DyStar will not knowingly collect personally identifiable information via the Site from visitors in this age group and will take prompt steps to delete any such personally identifiable information.
11. Indemnification.
    You agree to indemnify, defend, and hold DyStar, its affiliates, and their respective officers, directors, employees, shareholders, agents, and representatives harmless from and against any and all liability, loss, injury, demand, action, cost, expense, or claim of any kind or character, including, but not limited to, attorneys’ fees, arising out of or in connection with (a) any use of the Site by you except as expressly authorized by these Terms, (b) any information you submit, post to, or transmit through the Site, (c) your violation of any rights of any third party, in connection with your use of the Site, and (d) your failure to comply with any applicable law.
12.  Governing Law.
    These Terms and any controversy relating to them or the Site shall be governed by the laws of the State of North Carolina, excluding its conflicts of law principles.
